פרקליט מחוז מיסוי וכלכלה, יהונתן תדמור, על דעת היועצת המשפטית לממשלה ופרקליט המדינה, הודיע למר שלמה פילבר על כוונה לבטל את הסכם עד המדינה שנערך עימו לאחר שהונחה בפניהם תשתית ראייתית המלמדת על הפרת הסכם עד המדינה מצידו.

כבר לפני כחצי שנה, לאחר לאחר עדותו של עד המדינה פילבר במשפטו של ראש הממשלה בנימין נתניהו, הוחלט למנות את הפרקליט הבכיר עו"ד ניסים מרום לחבר חוות דעת שבמסגרתה ינתח את עדותו של עד המדינה שלמה פילבר ויקבע אם הפר את הסכם עד המדינה שנחתם עימו – זאת לאחר שבמהלך העדות בביהמ"ש ביקשה התובעת יהודית תירוש להכריז עליו עד עוין.

מרום בחוות דעתו קבע כי פילבר הפר את ההסכם כאשר במהלך עדותו הוא סתר באופן חזיתי עדויות שנתן במשטרה לאחר שחתם על הסכם עד המדינה. כמה מהן בעלות משקל רב.

לפרקליטות יש האפשרות להחליט האם להגיש כנגד פילבר כתב אישום פלילי או להסתפק בסנקציה כלכלית – אי השבת 200 אלף השקלים שהופקדו כערבות לעמידתו בהסכם עד המדינה.

בנוסף, ניתן גם להגיש נגדו תביעה אזרחית.
